What does an employer of record do in Viet Nam?
An employer of record (EOR) is a Vietnamese company that legally employs staff on behalf of a business that has no entity in Viet Nam. HR4U JSC (enterprise code 3703140197, labour leasing licence No. 24/2023/SBD) signs the labour contract under the Labour Code 2019, pays salary in Vietnamese dong, registers and pays social, health and unemployment insurance, withholds personal income tax and applies for work permits for foreign staff. Your company picks the person, sets the salary and manages the day-to-day work.
The HR4U JSC service fee starts from $109 per employee per month, excluding VAT. On top of the gross salary, employer contributions for a Vietnamese employee come to about 23.5%. Vietnamese hires can usually start as soon as the service agreement and labour contract are signed.

Questions foreign companies ask us.
Is using an employer of record legal in Viet Nam?
Yes, although no Vietnamese law uses the term "employer of record". A lawful arrangement relies on existing mechanisms: licensed labour leasing under Articles 52–58 of the Labour Code 2019 and Decree 145/2020/ND-CP, or direct employment by a Vietnamese company that provides services to you under a business-to-business agreement. HR4U JSC holds labour leasing licence No. 24/2023/SBD. When you request a quote, we tell you in writing which route applies to each role.
How quickly can my hire start?
A Vietnamese national can usually start as soon as the service agreement and labour contract are signed. A foreign hire starts once the work permit is issued; the provincial authority processes a complete application within 10 working days under Decree 219/2025/ND-CP.
What exactly does the $109 fee cover?
The service fee covers employing your hire through HR4U JSC: the labour contract, monthly payroll and payslips, insurance registration and filings, personal income tax withholding and finalisation, and onboarding and offboarding. Salary and statutory contributions are billed in addition. VAT is added to the fee.
Can we hire foreign nationals in Viet Nam through HR4U JSC?
Yes. HR4U JSC acts as the employer and applies for the work permit. People who work in Viet Nam for less than 90 days in total per year do not need a work permit. See foreign hires and work permits.
Who owns the work my employee produces?
The labour contract and the service agreement include confidentiality and intellectual-property clauses so that work produced for you belongs to your company. Tell us your requirements and we include them before signing.
Can we move the employee to our own entity later?
Yes. When your entity is ready, HR4U JSC ends its contract by agreement and your entity signs a new labour contract. We agree in advance how accrued benefits are handled so the employee is not affected.
